Stephen Pearce of North Standen - His Will 1782

 In this will transcript [ ] indicate items I could not decipher.

 In the Name of God Amen
I Stephen Pearce of North Standen in the Parish of
Hungerford in the County of Wilts Gentleman being weak in
body but thanks be to God of sound and disposing mind

and memory and considering the uncertainty of this transitory
life do make and ordain this my last Will and Testament
in manner following that is to say First I will and desire
that all such just debts as I shall owe at the time of my
decease the Expenses of my Funeral and testamentary
charges shall be paid and discharged by the Executors of
this my Will also I give and bequeath unto my Niece Ann
Neat now the wife of John Neat and to my Niece Sarah
Goodman now the Wife of James Goodman and Daughters of
my late Brother John Pearce the Sum of one hundred
Pounds apiece of lawful Money of Great Britain Also I
give and bequeath unto my Nephew James Knight son of
my sister Sarah Russell? the like sum of one hundred pounds
also I give and bequeath unto my Nephew John Smith son
of my late Sister Elizabeth Smith the sum of Four hundred
pounds of like lawful Money Also I give and bequeath unto
my Nephew John Snook son of my late Sister Mary
Ferryman the Sum of one hundred pounds of like lawful
money Also I give and bequeath unto my Nephew James
Snook and Thomas Snook two other sons of my said late Sister
Mary Ferryman the sum of Fifty pounds apiece of like lawful
money all which said last mentioned legacies I direct to be paid to
the respective legatees within one year next after my decease and in
case either of my said Nephews James Snook and Thomas Snook
shall happen to die within or before the time above limited for
Payment of their said respective legacies Then it is my express
Will and Meaning that the legacy or legacies of him or them
so dying within the time aforesaid shall sink and not be paid
and shall be considered as lapsed Legacies for the Benefit of the
Executor of this my Will any Thing hereinbefore contained to the
contrary not withstanding Also I give and bequeath unto my
Nephew Henry Snook another son of my said Sister
Mary Ferryman the sum of one hundred pounds of like
lawful Money to be paid to him by my said Executor in manner
following that is to say the Sum of Ten Pounds yearly and
every year during the Term of Ten years from the time of
my decease payable quarterly by four equal payments in the
year the first payment thereof to commence at the expiration
of three Months from the day of my death and in case the
said Henry Snook shall happen to die before the expiration
of the said Term of ten years Then I will and direct that my
said executor shall pay the residue of the said sum of one
hundred pounds which shall be so remaining in his hands
unto the legal Representative or Representatives of the said
Henry Snook within three months next after the decease
of him the said Henry Snook for the purpose of continued?
bringing up and maintaining his Children who shall survive
him Also I give and bequeath unto my Nephew John Pearce
son of my late Brother John Pearce the following Goods and
Effects that is to say In my Bedchamber a Feather Bed and the
Bedstead with Curtains and Vallons two sheets two Blankets two
Pillows two pillow cases one Bolster and coverlid? thereto

belonging an old Chest of Drawers a small Ash Table
a [] two Glasses and a Close? Stool on the Landing? place
at the top of the Stairs two large old Coffers and a Wall
Cupboard in the Pantry Chamber a Bed and Bedstead
with Curtains and Vallons? two sheets two Blankets two
Pillows two Pillow cases Bolsters and cases thereto belonging
In the Wainscot Chamber a Bed and Bedstead with Curtains
and Vallons two sheets two Blankets two Pillows two pillow
cases eeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeee
eeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeee
eeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeee
and Bolster cases thereto belonging to and for his own
proper use and Benefit Also I give and bequeath unto my
said Nephew John Smith my [ ] In the great
Chamber my best Bed and Bedstead with Curtains and
Valons and other Bedding and Furniture thereto belonging
a looking Glass a small Table with a Cloth over it on
the Landing Place a little Clork In the Kitchen a []
with its appurtenances compleat to hold to him the
said John Smith his Executors Administrators and Assigns
absolutely Also I give and bequeath unto my great []
Nephew Stephen Pearce a minor Son of my said Nephew
John Pearce all and singular my Silver and Plate []
whatsoever and wheresoever also all and every my Mahogany
Tables and Chairs at the Top of the Stairs a large round
oak table In the hall six pewter dishes marked JP In
the kitchen three other pewter dishes marked RFM
eighteen of my best pewter plates marked SP a Balance
and Weight my Gun compleat and case In the Porch a Beam
with weights and scales In the Great Chamber a Cabinet
a Chest of Drawers and a Cloaths Press In the old Parlour
a pistil compleat with a Pole? [ ] Pot together with
my Watch and my late Grandmother Pearces Wedding
Ring which she gave to me to be delivered to him [] the said
Stephen Pearce as soon as he attains his said age of twenty
one or twenty Four years at the discretion of his four
Trustees hereinafter named Also I give and bequeath unto my
said Nephews John Pearce and John Smith all the rest
and residue of my household Goods and Furniture which shall
remain at North Standen Farmhouse aforesaid at the time
of my decease to be equally divided between them share and
share alike Also I give and bequeath unto my said Nephews
John Pearce and John Smith and the Survivor of them his
Executors and Administrators the summ of three hundred pounds
of like lawful Money upon the Trusts and to and for their
several uses Interests and Purposes and under and subject
to the proviso hereinafter declared and expressed to []
that is to say Upon Trust to lend and place out the said
three Hundred Pounds at Interest upon such security
or securities either real or personal as they my said Trustees
or the Survivor of them his Executors or administrators

shall think fit and from time to time to call in and []
the same or any Part thereof and again from time to time
to [] and place out the said three hundred Pounds or any
part thereof in manner aforesaid and call in and service the
same [] and as often as ocasion shall require and pay
apply and dispose of the yearly Interest or Produce thereof
during the Life of my Sister ann Prior now the Wife of
Henry Prior of Chippenham in the said County of Wilts
Malster unto such person or persons and for such uses
Interests and Purposes as she my said sister ann Prior shall
from time to time notwithstanding her coverture? by any Note
or Notes in Writing under her hand direct or appoint to the
Intent that the same may not be at the disposal of or []
subject or liable to the Power or control [ ] Forfeitures
or Engagements of her present or any after taken husband but
only at her own sole and seperate disposal and from and after
her decease then upon Trust to pay the said sum of Three
hundred Pounds or to assign and transfer such security or
securities as shall or may be taken for the same unto Ann Prior
daughter of my said sister Ann Prior to and for her own
absolute use & Benefit Provided always that in case my said
sister Ann Prior shall happen to survive her said daughter
and without the said daughters leaving any Issue of her
Body her surviving that then and in such case I do hereby
will and direct that from and immediately after the decease
of my said sister Ann Prior the said sum of three hundred
pounds and the security or securities taken for the same shall be
assigned over unto or for the use and Benefit of the said Executor
of this my Will as I mean the same shall in that case be
considered as a lapsed legacy to the said Ann Prior the daughter
and not payable to her Representative pr Representatives Also
I give and bequeath unto my Niece Ann Prior the Sum
of one Hundred Pounds of like lawful Money to be paid
to her within one year next after my decease Also I give
and bequeath unto my said Nephew John Pearce and to
my trusty Friends William Clarke of Greenham in the County
of Berks Gentleman John Barcus of Shalbourn in the
said County of Wilts Gentleman and John Hunt Watts of
Ham in the same County Gentleman and the Survivors
and Survivor of them his Executors and Administrators the
Sum of Four Thousand and three Hundred Pounds of
like lawful Money upon the Trusts and to and for the
several Uses Interests and Purposes and under and subject
to the Proviso hereinafter declared and expressed [ ] the
same that is to say upon Trust that they the said John
Pearce William Clark John Barcus and John Hunt
Watts or the Survivors or Survivor of them his Executors or
Administrators do and shall as soon as conveniently maybe
next after my decease [] and place out the said Four Thousand
and three Hundred Pounds upon such security or securities
either real or personal as thet my said Trustees or the
survivors or survivor of them his Executors or Administrators

shall think fit and from time to call in and servise the
same or any part thereof and again from time to time
to [] and place out the said Four Thousand and three hundred
Pounds or any Part thereof at Interest in manner aforesaid
and call in and service the same when and as often as occasion
shall require and also upon Trust that they my said Trustees
or the Survivors or Survivor of them his Executors or
Administrators do and shall collect gather in and service the
yearly Interest or Produce thereof and from time to time
in like manner [] and place out such Interest to Interest
as the same shall increase and [] until the said Stephen
Pearce now an Infant the son of my said Nephew John
Pearce shall arrive to the Age of Twenty one or twenty
four years at the discretion of the said Trustees and when
he is arrived to such discretionary Age Then I give and
bequeath the said Sum of Four Thousand and three hundred
Pounds with all such Interest [] and Accumulation
which shall or may be made thereof unto the said Stephen
Pearce To hold the same and every Part thereof unto the
said Stephen Pearce his Executors Administrators and
Assigns to and for his and their own proper Use and Benefit
and I will and direct the said Trustees or the Survivors or
Survivor of them his Executors or administrators to assign
and transfer the security or securities which shall be taken
for the same accordingly provided always that in case the
said Stephen Pearce shall happen to die before he
arrives to his said Age of twenty one or twenty four years
that then and in such case the said sum of Four Thousand
and three Hundred Pounds with all such Interest []
[] and Accumulation which shall or may be made
thereof and the security or securities to be taken for the
same shall go to and be considered for the Benefit of my
said Nephew John Pearce to hold the same and every
Part thereof unto him the said John Pearce his Executors
Administrators and Assigns absolutely Also I give and bequeath
unto the Poor of the said Parish of Hungerford the sum
of Five pounds to be paid to them in Money or distributed
in Bread at the discretion of my said Executor and I
do hereby expressly ordane that they my said respective
Trustees and or either of their or any or either of their Executors or Administrators
shall not be chargeable ??ntable for any more
of the aforesaid Trust Monies or Estates respectively than
he or they shall severally and respectively actually survive?
or shall [] to their respective Hands by Virtue of this
or with or for any Loss or Losses which shall
or may happen of the said Trust Monies or Estates
of the other or others of them
respectively or any Part or Parts thereof nor shall
any or either of them respectively be answerable or
??able for the other or others of them or for the
Arts Deeds Receipts and Disbursements
but each and every of them
respectively for his or their
own Arts Deeds Receipts and
Disbursements
only and also that
it shall and may be lawful to and for my said several and
respective Trustees and their several and respective Executors

and Administra\tors to reimburse himself and themselves
respectively all such Costs Charges and Expenses as he or they
or any of them shall sustain expend or be put into for or by
reason of the Performance of the respective Trusts hereby in them
reposed or the Management or Execution thereof respectively or
any othe thing in any wise relating to the said respective costs Also all
the Rest Residue and Remainder of my ready Money and securities
for Money Goods Chattels Effects Substance and personal Estate
whatsoever and wheresoever not hereinbefore by me given
or bequeathed or disposed of I give and bequeath unto my said
Nephew John Pearce To hold to him the said John Pearce
his Executors Administrators and Assigns absolutely and I do
hereby make constitute and appoint my said Nephew John
Pearce sole Executor of this my last Will and Testament And i
do revoke and make null and void all other Wills and Testaments
by me at any time or times heretofore made and I do declare this
and no other to be my Last Will and Testament In Witness
whereof I the said Stephen Pearce the Testator have to
this my will contained in two large sized Sheets of Paper to
the first Sheet set my Hand and to the second and last sheet thereof
set my hand and seal the nineteenth Day of August in the yea\r of
our Lord one Thousand seven Hundred and Eighty two. Stephen
Pearce, Signed and sealed by the above named Stephen Pearce
the Testator and by him published and declared as and for his last
Will and Testament in the Presence of each other have hereunder
subscribed our Names as Witnesses thereto Thos Robinson [ ]

This Will was proved at London the thirty first
day of January in the year of our Lord one thousand
seven Hundred and Eighty three before the worshipful
Andrew [ ] Doctor of Laws Master
Keeper or Commissary of the Prerogative Court of
Canterbury lawfully constituted by the Oath of John
Pearce the Nephew of the deceased and sole Executor named
in the said Will to whom Administration was granted of all
and singular the Goods Chattels and Credits of the said deceased
having been first sworn duly to administer.
