Elizabeth was my 6xG aunt, A Very useful Will naming her Nephews & Nieces

In the Name of God Amen Elizabeth Crook of Tytherton Lucas in the Parish of Chippenham in the County of Wilts Spinster being in health & of sound disposing mind memory & understanding thanks be to God for the same hereby revoking all former Wills by me at any time herebefore? made do make publish & declare this to be my last Will & Testament in manner & form following that is to say first I Give to my Cousin Thomas Crook of Kellaways in the County of Wilts Gentleman all the Fixtures which shall be in the house wherein I now live at the time of my decease Also I Give to the said Thomas Crook the Sum of twenty Pounds over & besides what he will be entitled to under the bequest hereinbefore? contained as a recompence for the trouble he will have in the execution of this my Will And whereas my late deceased Sister Catharine Crook by her last Will & testament bearing date the sixth day of January 1788 gave unto me for my life all that are part in the Freehold in the Parish of Trowbridge in the County aforesaid & after my decease she gave the same unto our Brother Simon Crook during his life & after his decease to her Nephew Charles Crook Son of her said Brother Simon Crook & she did thereby also Give to her Niece Elizabeth Wife of John Eddols & Mary Crook & Catharine Crook Daughters of her late brother Robert Crook the Sum of twenty pounds each within the space of one year after my decease & all rest residue & remainder of her effects whatsoevervshe gave as follows unto her brother Edward Crook one half after my decease but if he should die before me then his part should be equally divided after my death amongst his the said Edward Crooks children [] alive her other half she gave unto William Crook Anthony Crook Edward Crook John Crook Elizabeth Eddols Mary Crook & Catharine Crook Sons & Daughters of her late Brother Robert Crook to be equally divided between them share & share alike within the space of one year after my death & she appointed me sole Executrix of her Will And [] my said Sister Catharine Crook at the time of making her said Will was only aforesaid Mortgagee in posession of the said Freelands? & premises in Trowbridge be given by her as aforesaid & having in her life time received all principle interest monies due on such [] mortgage she [] away all her rights & interest in the premises whereby the said [] thereof [] in due lapsed & my said brother Simon Crook & his children are in consequence thereof entirely excluded from all benefit under my said Sisters Will contrary to her intention & desire & I am therefore desirous by this my Will to [] such defect & to dispose of my property in such manner that the same together with the residuary Personal Estate of my said Sister Catharine Crook may with the exceptions herein mentioned be equally & impartially divided between & amongst my Nephews & Nieces & their representatives in manner hereinafter mentioned Now I do hereby Give & bequeath unto my said Nephews Thomas Crook all my Goods Chattels [] Securities for money & all my Personal estate & effects of what sort or kind soever the same may be of which I shall be possessed or entitled to hold the same unto the said Thomas Crook his Executors & Admons upon the trusts & [] & for the ends intents & purposes hereinafter mentioned that is to say upon trust that the said Thomas Crook his Executors & Admons do & shall as soon as reasonably may be after my decease posess [] themselves of all my said Personal estate & call in & receive all such Sum & Sums of money as shall be due & owing to me at the time of my death & sell dispose of and covert into money all such parts of my personal estate as shall not consist of money & by & out of the monies so by him or them to be posessed of & received? do and shall in the first place pay & discharge all my debts & funeral expenses & after paying the said several Legacies of twenty pounds each so given & bequeathed in & by the said Will of my said Sister Catharine Crook unto my said Nieces Elizabeth Eddols Mary Crook & Catharine Crook as aforesaid & paying & yielding? the residuary Personal Estate of my said Sister Catharine Crook in the manner directed by her said Will & after also paying or [] to himself the said Legacy of twenty pounds hereinbefore given to him the said Thomas Crook then upon trust that he the said Thomas Crook his Executors or Admons do & shall by & out of my said Personal Estate & Effects pay unto each of them my nephews & nieces ( that is to say himself the said Thomas Crook John Crook Simon Crook Robert Crook Walter Crook Catharine Brown & Mary Seager Children of my brother Edward Crook & my Great Niece Elizabeth Edwards ( Daughter of John Edwards of Hartham in the said County of Wilts Yeoman by Elizabeth his Wife who was also a Daughter of my said brother Edward Crook & the children of Jane Coward deceased which shall be living at the time of my death& [] said Jane Coward was likewise a daughter of the said Edward Crook such children of the said Jane Coward nevertheless to take only such share of my said Personal Estate as their mother would in case she was living & also unto such of my Nephews Charles Crook Henry Crook & George Crook Sons of my brother Simon Crook so much money as with the monies which they or my said brother Edward Crook will then have [] as under & by virtue of the said Will of my said Sister Catharine Crook will be equivalent to the shares of my said Nephews & Nieces William Crook Anthony Crook Edward Crook John Crook Elizabeth Eddols Mary Crook & Catharine Crook Sons & Daughters of my said late deceased Brother Robert Crook of & in the residuary Personal Estate of the said Catharine Crook deceased & upon this further trust that he the said Thomas Crook his Executors or Admons do & shall pay & equally divide the surplus or residue of my said Personal estate & effects after the several payments aforesaid shall have been made to between & amongst himself the said Thomas Crook & the said John Crook Simon Crook Robert Crook Walter Crook Catharine Brown & Mary Seager Children of my said brother Edward Crook my said Great Nice Elizabeth Edwards & the children of the said Jane Coward which shall be living at the time of my decease such children to take only such share between them of my said Personal Estate as their mother would in case she was alive & to & amongst the said Charles Crook Henry Crook & George Crook Sons of my said Brother Simon Crook & also to & amongst the said William Crook Anthony Crook Edward Crook John Crook Elizabeth Eddols Mary Crook & Catharine Crook Children of my late Brother Robert Crook equally share & share alike it being my Will & intention that all my said Nephews & Nieces or their representatives shall receive an equal & proportionable share of & in my said personal estate & the personal Estate & Effects of my said deceased Sister Catharine Crook except only that my said Nieces Elizabeth Eddols Mary Crook & Catharine Crook shall receive their said several Legacies of twenty pounds each under the Will of my said deceased Sister & my said Nephew Thomas Crook shall have & receive the fixtures in my said house the said Legacy of twenty pounds hereinbefore given to him over & above any of my other Nephews or Nieces & I do make ordain constitute & appointed the said Thomas Crook Sole Executorbof this my last Will & testament & I do will order & direct that he shall not be charged or chargeable with or accountable for more of the said trust estates & effects than shall actually come to his hands by virtue of this my Will nor with or for any loss which shall or may happen of the cause or as such loss happens without his wilful neglect or default & that it shall be lawful for him to reimburse himself in the first place by & out of the said trust estate all such costs charges & expenses [] he shall be put into in the execution of this my Will or the trusts hereby in him reposed In witness whereof I the said Elizabeth Crook the testatrix have to this my last Will & testament contained in three sheets of paper to the first two sheets thereof set my hand & to this last sheet set my hand & seal this twenty fourth day of December in the year of our Lord 1799 E Crook Signed Sealed Published & declared by the said Elizabeth Crook the testatrix as & for her last Will & testament in the presence of us who have attested the same in her presence Anthy Guy Harry? Powell This is a Codicil to the last Will & testament of me Elizabeth Crook of Tytherton Lucas in the County of Wilts Spinster which I will may be taken as part thereof & as if inserted therein whereas I have in my said Will to which this is annexed directed the residue of my Estate & Effects after the several payments therein mentioned are fully paid & satisfied to be divided as is therein also mentioned between & amongst the children of my brothers Edward Crook Simon Crook & Robert Crook and when [] making my Will Robert Crook Son of Edward Crook & Edward Crook Son of the said Robert Crook are both dead leaving children now my Will is & I do hereby direct & declare that the children of the said Robert Crook & Edward Crook shall be entitled to such share of my said Estate & Effects as their respective parents would in case they had been living at my decease & I hereby give the same to them accordingly I give to William Crook of Tytherton Lucas [] Son of Thomas Crook two pair of Silver table Spoons One marked E Catharine & the other (C) only & in all other respects I confirm my Will In Witness whereof I have hereunto set my Hand & seal the tenth of May 1802 Elizth Crook Signed Sealed Published & declared by the above named Elizabeth Crook as & for a Codiciul to her Will in the presence of us Anthy Guy Grace Powell Proved at London with a Codicil 3rd Feby 1814 before the Judge by the oath of Thomas Crook the Sole Executor to whom Admin was granted having been first sworn duly to Admn
