Edward Baker Eddolls of Highfield - his Will - 5 Oct 1771

In the Name of God Amen I Edward Baker Eddolls of Highfield in the County of Gloucester yeoman being weak in body but of sound and disposing mind memory and understanding thanks be to Almighty God for the same do make and publish this my last Will and Testament commending my Soul into the hands of Almighty God hoping for Salvation through the merits and mediation of my blessed Saviour Jesus Christ and my body I commit to the Earth to be decently interred at the discretion of my Executors hereinafter named and as to my worldly Estate wherewith it has pleased God to bless mediation I dispose thereof in manner following (that is to say) First I give devise and bequeath unto Joseph Golbourne of Hardenhuish in the County of Wilts Esquire and Francis Jaques of the City of Bristol Baker and to their Heirs all those my Messuages Tenements Barns Stables outhouses Buildings Lands Beast Leazes and Heretitaments situate lying and being in the several Parishes of Langley Burrell Chippenham and Hardenhuish some or one of them or elsewhere in the said County of Wilts To hold to the said Joseph Golbourne and Francis Jaques their Heirs and assigns for ever In Trust to sell and dispose thereof as soon after my decease as conveniently may be for the best price or prices that can or may be had or obtained for the same and out of the Moneys arising by such Sale in the first place to pay and discharge all my just debts and Funeral Expenses and the Residue thereof to place out at Interest on Government or Real Securities and the Interest thereof from time to time to receive pay and apply the same towards the Maintenance of my Wife and Children until my eldest son Edward Eddolls shall arrive to the age of twenty two years and then to call in fifty pounds part of the said principal Money and pay the same to my said Son Edward Eddolls and when and as soon as my said Son Edward Eddolls shall arise? to the age of twenty seven years then to call in the Sum of one hundred pounds other part of the aforesaid principal Moneys and pay the same to my said Son Edward Eddolls and so from time to time as often as my several other Children shall severally arise to the age of twenty seven years (that is to say) Elizabeth Mary Ann John Thomas Francis Catharine and Jane Eddolls to call in further part of the said principal Money and pay to each of them the Sum of fifty pounds Also I give devise and bequeath unto the said Joseph Golbourne and Francis Jaques all my personal Estate of what nature or kind soever In Trust to sell and dispose thereof for the best price or prices that can or may be had or obtained for the same and the Moneys arising therefrom to place out at Interest in manner as aforesaid and the Interest and Increase thereof from time to time to service? and pay towards the Maintenance of my said Wife and Children and when and as soon as my said daughter Jane shall arive to the Age of twenty seven years and all the aforesaid Legacies shall be fully satisfied and paid I direct my said Trustees to continue five hundred pounds part of the aforesaid principal ou at Interest in manner as aforesaid and the Interest and Increase thereof from time to time to service and pay to my said wife for and during the rest of her natural Life and the Residue of the aforesaid principal except the aforesaid five hundred pounds to equally divide between my said Children which shall be then living share and share alike and from and immediately after the decease of my said Wife then I do hereby further direct my said Trustees to call in the said Sum of five hundred pounds [] pay and apply the same to and among all my said Children which shall be then living share and share alike And my Will and meaning further is that in case any or either of my said Children shall be minded and be willing to be placed out apprentice that then and in such case I do hereby further direct my said Trustees to apply part of his her or their Legacies so devised to him her or them as aforesaid for and towards apprenticeing such Child or Children And I do hereby constitute and appoint the said Joseph Golbourne and Francis Jaques joint Executors of this my last Will and Testament And my further Will and Meaning is and I do hereby will and declare that my said Trustees or their Heirs shall not be liable to make good any Loss that may happen to be sustained through the Insufficiency of any Security or Securities on which the said several Sums of Money or any part thereof shall be from time to time placed out at Interest neither shall the one of them be responsible for the art or good of the other of them or for any Loss that may happen unless through his or their own wilfull default and that they may reimburse themselves out of the Effects which they [] or stand In Trust for all such Charges and Expenses as they shall necessarily sustain or be put unto in the Execution of the Trust hereby in them reposed And I do hereby revoke all former Wills by me before made I Witness whereof I have to this my last Will and Testament set my hand and Seal the fifth day of october in the year of our Lord one thousand seven hundred and seventy one Edwd Baker Eddolls Signed sealed published and declared by the said Edward Baker Eddolls the Testator as and for his last Will and Testament in the presence of us who in his presence and in the presence of each other have set our Names as Witnesses thereto - Wm Dummer - Benj Jason Perrott - John Stanford Perrott This will was proved at London on 16th April 1772. Francis Jaques was sworn as an executor. This power was reserved for Joseph Golbourne.
