John Slade of Aston Upthorpe - his Will - 1766

John Slade was my 5x Great Grandfather. More of his details can be found here. His relationship to my Mother can be found here. In his Will there are some places where information seems to be repeated and in the wrong order.

 In the Name of God Amen
I John Slade of Aston Upthorpe otherwise Up Thrup in
the County Of Berks Gentleman Although at present weak
in body but of a sound and disposing Mind Memory and
understanding Thanks be to God for the same do make
this my last Will and Testament in manner and form
following that is to say In the first place I do hereby
Commend my Soul into the hands of almighty God who
gave it hoping for Salvation through the Merits of my
Lord and Saviour Jesus Christ and my body I commit to the
Earth to be decently interred at the discretion of my
Executors hereinafter named And as to such worldly
Estate wherewith it hath pleased the Lord to bless me
I Give and dispose of the same as followeth viz I Give and
bequeath unto my Daughters Mary Slade Frances Slade and
Sarah Slade and to such Child or children as my Wife
Martha Slade is now [] with (if born alive) the Sum
of Six hundred pounds of lawful Money of Great Britain to
each of them to be paid to them respectively at their
respective ages of twenty one years and in case any or
either of them shall happen to die before he she or they
shall attain to the said age of twenty one years Then I do
hereby Give and bequeath the Legacy or Legacies hereinafter
before given and bequeathed to him her or them so dying
unto the survivors and survivor of them and my Son John
Slade equally to be divided between them share and
share alike Item I do hereby Give and bequeath unto my
daughter Martha Tull Wife of John Tull of Southridge
in the said County of Berks yeoman the sum of One hundred
pounds to be paid to her within one year next after my
decease and I do hereby Charge all and singular my
Messuages Lands Tenements Hereditaments and premises
lying and being in Aston Upthorpe otherwise Up Thrup
aforesaid or ] in the said County of Berks with
the payment of the several Legacys aforesaid or so ]
thereof as my personal Estate shall fall short of or be
deficient in paying and in the mean time and until the
several Legacys given? to my children as aforesaid (except
the legacy given to my Daughter Tull as aforesaid) shall
become due and payable I do hereby direct and appoint
that they my said children shall each of them have and
be entitled to the ] sum of twenty pounds yearly
out of the Rents Interest and Profits of my Real and
Personal Estates for and towards their respective maintenance
and Education to be paid to their respective Guardian

or Guardians half yearly on two of the most usual Feasts
or days of Payment in the year that is to say the Feasts
of Saint John the Baptist and the Birth of our Lord Christ
by [] and equal portions the first payment thereof to
begin and be made on such of the said Feasts as shall
happen next after my decease Item I do hereby Give
devise and bequeath unto John Fuller of Aston Tirold in
the said County of Berks Gentleman and Thomas Humfrey
of East Hagbourne in the said County of Berks [] all
my Messuages or Lands Tenements Hereditaments and
premises whatsoever with their appurtenances situate and
being in Aston Upthorpe otherwise Aston Up thrup aforsd
or wheresoever else the same shall be which I shall be
seized of or entitled unto at the time of my decease and also
all and singular my Goods Chattels Stock of corn and
cattle and all my Effects in Husbandry and also all otherwise
my Personal Estate and Effects of what nature or kind
[] or wheresoever the same shall be which I shall
be possessed of interested in or intitled unto at the time
of my decease To hold unto the said John Fuller and
Thomas Humfrey their heirs Executors administrators
and assigns for ever (subject to the payment of my debts
Funeral Expenses and Legacies as aforesaid) upon the
Trusts nevertheless and to and for the several uses Intents
and purposes hereinafter mentioned limited and declared
performing? the same that is to say Upon Trust that they
the said John Fuller and Thomas Humfrey and the
survivor of them his Heirs Executors administrators or
assigns do and shall as soon as conveniently may be
after my decease let and ] my Real Estate to such personal
or persons as they shall think proper and [] the
Rents? and profits thereof and also sell and dispose of all
my personal Estate and Effects whatsoever and place or
put ou the proceeds arising by the sale thereof and by
the principle? on of the Rents and Profits of the said Real
Estates after all necessary payments being first made
thereto on such Government or other security or securitys
at interest as they the said John Fuller and Thomas
Humfrey or the survivor of them his Heirs Executors
or administrators shall think proper to and for the
benefit and advantage of my said son John Slade his
Heirs Executors and Administrators until he shall attain
the age of twenty one years and when and as soon as
my said son John Slade shall attain his age of twenty one years
then upon trust that they the said John Fuller and
Thomas Humfrey and the survivor of them his Heirs
Executors or administrators shall stand seized and
possessed of all and singular my Real and Personal
Estates herein before given devised and bequeathed to
them as aforesaid and the Interest and profits arising
therefrom to and for the only proper use and behoof of
my said son John Slade his Heirs Executors administrators

and assigns for ever and to or for no other use Trust intent or
purpose whatsoever and I do hereby direct and appoint the said John Fuller
and Thomas Humphrey and the Survivor of them his Heirs Exors or administrators
administrators to lay out the sum of thirty pounds yearly
or more or less as they or either of them shall think fit
for the Maintenance Education and bringing up of my
said son John Slade until he shall attain to his age of
twenty one years as aforesaid and I do hereby further
declare my Mind and Will to be tthat it shall and may be
lawful to and for the said John Fuller and Thomas Humfrey
and the successor of them his Heirs Executors or administrators
to reimburse to him and themselves out of the Rents
and profits of my Real and personal Estate as aforesaid
all such costs and charges as they or either of them shall
or may expend or be put unto in the Management or
Execution of the Trusts by this my Will reposed in them or
him or any ways relating thereunto and that they the
said John Fuller and Thomas Humfrey or the survivor
of them his Heirs Executors or administrators shall not
be answerable the one of them for the other of them or
of the other of them each of them for his own acts Receipts Heirs Executors and administrators
for the acts Receipts []Executors administrators only
and that they the said John Fuller and Thomas Humfrey their
Heirs Executors or administrators shall not be answerable
or accountable for any involuntary loss or losses that shall
or may happen to the said Trust Estates and premises in
any wise heresoever? so as that the same do not happen
through their any or either of their wilful [] or
default and I do hereby Give and bequeath unto the said
John Fuller and Thomas Humfrey the sum of ten pounds
to each of them for their care Trouble and Management
of the Trusts by this my Will reposed in them and I do
hereby Nominate constitute and appoint the said John
Fuller and Thomas Humfrey Executors in Trust of this
my Will hereby revoking all former Wills by me at any
time heretofore made and decare this only to be my
last Will and Testament In Witness whereof I have to
this my last Will and Testament contained in this and the
two preceeding sheets of paper set my hand and seal this
thirteenth day of August in the year of our Lord one thousand
seven hundred and Sixty Six John Slade signed sealed
published and declared by the said Testator John Slade as
and for his last Will and Testament in the presence of us
who at his request and in his presence and in the presence
of each other have subscribed our Names as witnesses
thereunto Will Pope Martha Porter Richd Halton

Memorandum that I John Slade
the Testator named in the Will hereunto annexed do
hereby further declare my Mind and Will to be that in
case the child with which my Wife martha Slade is now
cusient? with shall happen to be a Boy or a son Then I
do hereby declare my Mind and Will to be that []
John Fuller and Thomas Humfrey nominated in my
said Will and their Heirs shall stand seized and possessed

of so much of my Lands Tenements and Hereditaments
lying and being in Aston Up thrup als Upthorpe in the
county of Berks by my said Will given and deeded? to them
and their Heirs ( in the manner therein mentioned) as
heretofore purchased and bought of Mr Joseph Fuller of
Aston Tirrold in the said county of Berks being three
yard Lands to and for the use and benefit of such Boy
or son his Heirs and assigns for ever in case he shall
live to attain to the age of twenty one years over and
above the sum of Six hundred pounds given and
bequeathed to such child as my said Wife is now sensient?
with shall happen to be a Girl or a Daughter then she
shall have only the sum of Six hundred pounds and such
other Interests and advantages as are given and will
arrive to such child by my said Will and do hereby desire
and declare this present writing to be a supplement unto
or codicil to my last Will and Testament hereunto annexed
bearing date the Thirteenth day of August last In Witness
whereof I the said John Slade have hereunto set my hand
and seal this Thirteenth day of September in the year of our
Lord one thousand seven hundred and sixty six John Slade
Signed Sealed Published and decared by the said John
Slade as a ] and supplement unto or Codicil to his last
Will and Testament in the presence of us who at his
request and in his presence and in the presence of each
other have Subscribed our Names as Witnesses thereunto

Memdum I John Slade the
Testator named in my last Will and Testament hereunto
annexed do hereby further declare my Mind and Will
to be That as to all such part of my personal Estate given
and bequeathed to messrs John Fuller and Thomas
Humfrey in my said Will named in that manner therein
mentioned and? shall consist in Household Goods at the time
of my decease I do hereby declare my Mind and Will
to be That the said John Fuller and Thomas Humfrey
and the survivor of them his Executors and Administrators
shall stand possessed of such household Goods In
Trust to permit and suffer my Wife Martha Slade and
her children by me to have the use and wear of the
same until my Son John Slade shall attain to his age
of twenty one years and then for my said son John Slade
to have one Moiety or half part of all such Household
Goods as he shall think fit to and for his own use and
benefit and the oother half part thereof to go amongst
and be had and enjoyed by my said Wife and the rest
of her children by me to and for her and their own
use and benefit equally to be divided between them
share and share alike and I do hereby desire and

declare this present writing to be a further Supplement unto
or Codicil to my said last Will and Testament hereunto
annexed and to be deemed and taken as part thereof In
Witness whereof I the said John Slade have hereunto set
my hand and seal this seventeenth day of September in the
year of our Lord one thousand seven hundred and Sixty Six
John Slade Signed Sealed published and declared by the said
John Slade as a further Supplement unto or Codicil to his
last Will and Testament in the presence of us who at his
request and in his presence and in the presence of each other
have Subscribed our Names as witnesses thereunto Will

This Will was proved at London with two Codicils
on the twentieth day of November in the Year of our Lord one
thousand seven hundred and Sixty Six before the Right
Worshipful George Bay Doctor of Laws Master Kepper or
Commissary of the prerogative court of canterbury lawfully
constituted by the oaths of John Fuller and Thomas Humfrey
the Executors named in the said Will to whom administration
was granted of all and singular the Goods Chattels and credits
of the said deceased having been first Sworn by Commission
duly to administer.
