Edward Crook of Tytherton Lucas - his Will - 1742

 In the name of God Amen I Edward Crook of Tytherton Lucas in the

parish of Chippenham in the County of Wilts Gentleman being of sound and perfect
mind and memory Do make this my last Will and Testament in manner following
(that is to say) First I recommend my Soul into the hands of Almighty God who gave
it me and my Body to be decently Buried at the direction of my Executors hereinafter
named as for my worldly Estate wherewith it hath pleased God to Bless me I dispose
thereof as follows Also I give and bequeath unto my Dear wife Elizabeth one 
moyety or half part of my plate household goods and implements of Household
whatsoever And I also give to my said wife one hundred pounds to be paid to hereinafter
by my Executors within Three months next after my decease And the other moyety
and residue of all my plate Household goods and implements of Household I give and
bequeath unto my son Thomas Crook Also I give and bequeath unto my son
Thomas Crook one moyety or half part of all my Waggons Carts Dungpotts
Sullows Harrows Draggs Harness for Horses and Open? and of all other my
implements of Husbandry whatsoever Also I give and bequeath unto my Brothers
Thomas Crook and Simon Crook (whom I do appoint Trustees of this my Will) one
Guinea apiece Also I give & Devise unto my son Edward Crook and to his heirs &
assignes forever All my Lands Tenements and hereditaments situate and being
in Tytherton Lucas aforesaid which I purchased of George Townsend deceased
over and besides what are included in my marriage settlement on my present 
wife Also I give and bequeath unto my said son Edward Crook the sum of
Five hundred pounds to be paid him by my Executors within three months next
after my decease to the intent and I do hereby charge and direct my said son Edward
Crooke immediately on receipt thereof that he shall thereout pay and deliver unto
the hands of the said Thomas Crook and Simon Crook or the survivor of them his
Executors or Administrators the full sum of Four hundred pounds which said Sum
of Four hundred pounds I do hereby direct & desire of the said Thomas Crook and Simon
Crook & the survivor of them his Executors and Administrators to receive the same and
give my said son Edward Crook a proper discharge therefore in full as & for the
same sum of Four hundred pounds mentioned & charged to be raised on that granteth
Lands that I purchased of George Townsend & are specified in the settlement on
my present wife and the said Thomas Crook and Simon Crook & the survivor of them
his Extors & Adms shall & will pay and dispose of the said sum of Four hundred
pounds to and amongst my four younger Children that are not already provided
for Simon Crook Robert Crook Elizabeth Crook and Katharine Crook in part of
their Fortunes of Three hundred pounds each that I intend herein after
to give to each of them & to pay & apply the said Sum of Four hundred pounds
in such manner & on such Conditions as are herein after directed Also I
give and bequeath unto my said Son Edward Crook the other Moyety or half
part of all my wagons Carts Dungpots Sullows Harrows Drags Harness
for Horses & Oxen & of all other my implements of husbandry whatsoever
All the rest and residue of my ready money security for money goods
Chattells and Personal Estate of what nature & kind so ever the same be
 
I give and bequeath unto my sd Trustees Thomas Crook & Simon Crook whom I do
hereby appoint joynt Extors of this my Will & the survivor of them his Extors Adms
In trust nevertheless to & for the several uses intents & purposes herein after mentioned
(that is to say) that they my said Trustees & the survivor of them his Extors & Adms
shall out of my personal Estate pay my just Debts & Funeral Expenses And after
full payment thereof Then in trust that they my said Trustees or the survivor of them
his Extors or Adms shall and will thereout pay unto my sd Sons & Daughters Simon Crook
Robert Crook Elizabeth Crook & Katharine Crook Two hundred pounds each which
with their dividend of the Four hundred pounds mentioned to be raised for my younger
Children in my present inter marriage settlement in the whole to Three
hundred pounds each Child which said Sum of three hundred pounds I do hereby
direct my said Trustees & the survivor of them his Extors & administrators to pay
to each of them at their several & respective ages of one & twenty years or day
of marriage with the consent of my sd Trustees the interest in the meantime
to be paid unto my said wife & to be by her applied to and for the maintenance and
education of my said Children during their minority Then upon their further
Trust that they my sd Trustees & the survivor of them his Extors or Adms shall & will
after full payment shall be made of the said several sums of Five hundred pounds
Three hundred pounds Three hundred pounds Three hundred pounds Three hundred
pounds in the manner aforesaid pay and dispose of and deliver the remainder of
the same personal Estate by [] all shares and proportions to and amongst my
sons and Daughters Alice Crook John Crook Simon Crook Robert Crook Elizabeth
Crook & Katharine Crook when they shall have attained to their respective ages of
one & twenty years or day of Marriage with the consent of my Trustees the
interest thereof in the mean time to be paid to my sd wife & to be by her applied to
& for the maintenance & education of my sd Children during their minorities
provided always & my will meaning & desire is that if all or any of my sd Children or the
heirs Extors Adms Trustees or assigns of any or either of them or any other person or persons
claiming under his her or their or any or either of them shall at any time or times hereafter
ask demand or require of & from my sd Son Edward Crook or of or from all or any or either of
the Trustees mentioned in the sd Settlement or their or any or either of their
representatives or of the sd Thomas Crook & Simon Crook or either of their representatives
all or any part or share of the said Sum of Four hundred pounds mentioned in the said
Marriage settlement to be raised out of that part of the Lands that I purchased
of George Townsend / save as herein is mentioned / Or if all or any or either of
my said Children or their any or either of their representatives shall at the
time of their being paid his her or their Legacy of Three hundred pounds refuse
to release his her or their right or share in the said Four hundred pounds before
mentioned to be raised out of the said settled Lands And also to release & discharge
my said son Edward Crook his Extors & Adms and all my said Trustees & their
& each of their representatives from being any further accountable therefore
That then & in such case the Legacy or Legacys Summ or Summs of money hereby
 
given to such of my Child or Children or their representatives so claiming a right or share
in the said Four hundred pounds so charged on the said settled Lands I do hereby
wtall? revoke & make void such Legacy or Legacies Sum or sums of money so given
to him her or them as aforesaid and I do hereby give & bequeath the Legacy or Legacies
of him her or them so demanding a right or share in the said Four hundred pounds and
as aforesaid or to give such releases as aforesaid unto my said son Edward Crook
his Extors or Adms anything herein before contained to the conrary thereof
in any wise not withstanding And I do hereby declare that my said Trustees and
Extors shall not be accountable for the Actions of one another nor answerable
for any monies by them or either of them put out at interest which may be
lost by bad or insufficient securities And I do hereby revoke all former or other wills
by me heretofore made and do declare this to be my last Will and Testament
In witness whereof I have to this my will contained in three sheets of
paper to the two first sheets set my hand & to the third my hand and seal
the Five and twentieth day of August in the year of our Lord one thousand
seven hundred and Forty two, 1742.

Signed sealed and delivered published and declared
by the above named Edward Crook the Testator as and
for his last Will and Testament in the presence of uses
who subscribed our names as witnesses to the due
execution hereof in the Testators sight & presence and
in the presence of each other
