Edward Crook of Hilmarton - his Will - 1800

In the Name of God Amen I Edward Crook of Corten in the County of Wilts Gentleman do make publish and declare this to be my Last Will and Testament in manner following (that is to say) First I give and bequeath unto my Grand daughter Elizabeth Edwards the Sum of one hundred pounds to be paid to her when and as soon as she shall attain her age of twenty one years or day of marriage which shall first happen But if my said Grand daughter shall die under that age and unmarried Then I will and direct that the said Sum of one hundred pounds shall fall into and be considered as part of my Personal Estate hereinafter bequeathed Also I give and bequeath unto my Sons Thomas and Walter all that my Farm and Lands lying and being at Corten aforesaid which I hold by Lease under Maudlin College Oxford To hold to them my said Sons for all my Term Estate and Interest to come therein upon the several Trusts nevertheless hereinafter mentioned concerning the same that is to say upon Trust that they my said Sons do within three months next after my decease [] my said farm and Lands and my Term Estate and Interest to come therein to be estimated appraised and valued by three indifferent and competent persons one to be named by each of them by my Sons Thomas and Walter and the other to be named by my Sons John and that they my said Sons Thomas and Walter do and shall within six months next after my decease [] assign or otherwise assure the said Farm and Lands to him my said son John his Executors Administrators and Assigns for all my Term Estate and Interest to come therein provided and upon Condition that if her my said Son John shall be desirous of becoming the purchaser of my said Farm and Lands at and for such Price or Sum of Money as [] same shall be estimators appraised and valued at as aforesaid and at such his desire shall ge my said Sons Thomas and Walter Notice in writing at least one Month before the expiration of the said six Months and Pay or otherwise account to my said Sons Thomas and Walter for the Purchase Money at the time the said conveyance or assurance to him shall be granted provided always and it is my Will that in case my said Son John shall refuse to become the Purchaser of my said Farm and Lands or neglect to nominate a Proper Person to estimate and Appraise the same jointly with the two Persons to be nominated by my said Sons Thomas and Walter or shall omit or refuse to pay or otherwise account for the Purchase Money as aforesaid Then it is my Will that my said Sons Thomas and Walter do and shall with all convenient speed sell and dispose of my said Farm and Lands for the most Money and best Price that can or may be reasonable gotten for the same Also I give and bequeath unto my said three Sons Thomas John and Walter the Monies to be produced by the Sale of my said Farm and Lands as aforesaid whether Purchased by my said Son John or any other Person and all and singular my Monies and Securities for Money and all other the Personal Estate and Effects of or to which I shall be possessed or intitled at the time of my decease upon the several Trusts nevertheless hereinafter mentioned and expressed concerning the same (that is to say) Upon Trust nevertheless [] with all convenient Speed after my decease to call in such Monies as may be due to me and reinvest into ready Money such Part of my personal Estate as shall no then consist of ready Money And upon further Trust to divide the [] produce of my said Monies and Estate which and as the same shall be gotten in or come to the hands of them my said Sons Thomas John and Walter or any or either of them into eight equal parts or shares And upon further Trust also to pay retain or keep one of the said eight parts or shares to and for the proper use and benefit of my said Son Thomas another of the said eight Parts or Shares to and for the Proper use and Benefit of my said Son John and another of the said eight Parts or shares to and for the Proper use and Benefit of my said son Walter and also to pay one other of the said eight parts or shares to each of my said Sons Simon and Robert and my daughter Mary Wife of William Seager and Catherine Wife of John Brown And upon further Trust to pay and divide the other of the said eight parts or shares to and among the several Children of my daughter Jane deceased late Wife of Thomas Coward who shall be living at the time of my decease to be equally divided between them share and share alike to be paid to such of them as are Sons at their respective ages of twenty one years and to such of them as are daughters at their respective Ages of twenty one years or days of Marriage which shall first happen And in Case of the deaths of any or either of them before their respective shares shall become payable then to divide and pay the share of those dying to the others or other of them who shall live to become intitled to the original Shares And I do hereby direct and impower my said Sons Thomas John and Walter to put and place the shares of the said Children of my daughter Coward out at Interest on Government ] Security until the same shall become payable as aforesaid Also I do hereby nominate and appoint my said Sons Thomas John and Walter Executors of this my Will In Trust for the Purposes aforesaid And Lastly I do hereby direct that they my said Executors and Trustees be put to no Costs Charges or Expenses in the Execution of the Trusts hereby reposed in them nor shall they be answerable or accountable for the Arts or Neglects of the others or either of them but each for his Own Arts Receipts and Neglects only nor shall they be answerable for any Posses which may happen to my Trust Estate or Monies except the same happen by their wilful Default or Neglect and that they shall be at Liberty to retain and pay each other out of the said Trust Estate and Monies all such Costs Charges and Expenses which they or any or either of them may Pay bear sustain or be put unto in and about the Execution of the same Trusts In Witness whereof I the said Testator have to the first Sheet of this my Last Will and Testament contained in two Sheets of Paper set my Hand and to this second or last Sheet thereof my Hand and Seal the thirty first day of January in the year of our Lord one thousand and eight hundred EDward Crook Signed sealed Published and declared by the said Testator Edward Crook as and for his last Will and Testament in the presence of us who at his request and in his Presence and in the Presence of each other have subscribed our Names as Witnesses thereto Jos Breach James Lewis This Will was proved at London the thirteenth day of december in the year of our Lord one thousand eight hundred and two before the Right Honourable Sir William Wynne Knight doctor of Laws Master or Commissary of the prerogative Court of Canterbury lawfully constituted by the oaths of Thomas Crook John Crook and Walter Crook the Sons of the deceased and the Executors named in the said Will to whom administration of all and singular the Goods Chattels and Credits of the said deceased was granted they having been first sworn by Commission duly to administer.
