of me Thomas Crook of Titherton in the County of Wilts Esquire
give devise and bequeath all my Messuages Lands Tenements Heredits
and real Estate whatsoever and wheresoever and all my Goods
Chattels Personal Estate and Effects of what nature or kind soever
and to the use of my Son in Law Thomas Ebsworth and William
Gent Wood their heirs Executors Administrators and Assigns respectively
Upon Trust with all convenient speed after my decease to sell and
dispose of all my Messuages Land Tenements Hereditaments and
real Estate either together or in parcels and either by public sale
private contract for the best price or prices that can be obtained for
the same and to sell dispose of get in and convert the whole of
my goods chattels personal Estate and Effects into money and by
and out of the money to arise and be produced from my Real
and personal Estate In Trust to pay all such charges by way
of mortgage or otherwise as my affect my real Estate or any part
thereof and all other my just debts and my funeral expenses and
the expenses of proving this my Will and to stand possessed of the
residue or surplus of all the money to arise from my real and
personal Estate In Trust for my three daughters Mary Susannah
the Wife of the said Thomas Ebsworth Ann the Wife of the said
William Gent Wood and Lucy Koren? Happuth? Crook in equal
shares and for their respective Executors Administrators and Assigns
and I declare that the receipt or receipts of the said Thomas Ebsworth
and William Gent Wood or of the Survivor of them or of the
Executors Administrators or Assigns of such Survivor shall be goods
and effectual discharges in the law to the puchaser or purchasers of
all or any part or parts of my real Estate for so much as in such
receipt or receipts shall be acknowledged to be received and that such
purchaser or purchasers shall not afterwards be answerable or
accountable for the money so received or any part thereof or for
any loss misapplication or nonapplication thereof or of any part
thereof provided always And I direct that until my real Estate
shall be sold the rents issues and profits thereof shall be paid to
my said three daughters in equal shares or to their respective
Executors Administrators or Assigns And I declare and direct that
if either of them the said Thomas Ebsworth and William Gent
Wood shall die or refuse or decline to act in theTrusts of this
my Will then a new Trustee or Trustees may be appointed by
the Trustee or Trustees so declining to act or by the Executors or
Administrators of such of them as shall so die and that the said
Trust Estates so to be vested in such now and such surviving or
continuing Trustees or Trustee upon the same Trusts and with the
same powers as are hereinbefore mentioned and declared and so
from time to time as often as that case shall happen and I
appoint the said Thomas Ebsworth and William Gent Wood and
my Wife Mary Susannah Crook Executors and Executrix of this my
Will and the reason of my not making any provision in
this my Will for my said Wife is because she has sufficient property
of her own independent of me And I declare that my said Trustees
Executors and Executrix shall not be answerable one for another and
by no means for involuntary losses and that they shall be allowed
and may retain to and reimburse themselves out of the produce
of my real and personal Estate all their Costs Charges and Expenses
to be occasioned by the due execution of the Trusts hereby in them
reposed And I hereby revoke all my former Wills In Witness whereof
I have to this my last Will and Testament set my hand and seal
this twenty third day of August in the year of our Lord One
thousand eight hundred and twenty one Thos Crook as and
for his last Will and Testament in the presence of us who in his
presence at his rewquest and in the presence of each other have
hereunto subscibed our names as Witnesses thereto R H Gaby
